Italy's DPA Blocks ChatGPT, Citing GDPR Concerns and Risks to Minors

Following a recent open letter requesting the halt of more advanced generative AI model development, Italy's data protection authority (DPA) has taken swift action by ordering OpenAI to cease processing people's data locally. Citing potential violations of the European Union's General Data Protection Regulation (GDPR), the Italian DPA has launched an investigation into the matter.

The DPA has expressed concern that OpenAI may have processed people's data unlawfully and failed to implement proper measures to stop minors from accessing their technology. As a result, the San Francisco-based company faces a blockade on their ChatGPT system and has 20 days to respond to the order. GDPR breaches may lead to hefty fines, amounting to either 4% of a company's annual turnover or €20 million, whichever is higher.

Importantly, since OpenAI lacks a legal entity within the EU, any local data protection authority can intervene under the GDPR. Consequently, other countries may consider following Italy's lead to address potential risks to their citizens. The GDPR applies when the personal data of EU users is processed. However, the technology used by OpenAI creates complex scenarios involving massive amounts of data processing that challenge the legality of their methods.

Additional GDPR concerns emerge, given that ChatGPT has been found to generate entirely false information about individuals, potentially complicating the rectification of errors. OpenAI has not provided clarification on whether users can request corrections of incorrect information produced by their AI bot. Data breaches, another area regulated by GDPR, also factor into the situation, after OpenAI recently admitted to leaking chat data and potentially exposing users' payment information.

Data minimization principles embedded within GDPR, which emphasize transparency and fairness, call into question OpenAI's lawful basis for processing European data. If unlawful processing is determined, data protection authorities across the union may order OpenAI to delete the data. The repercussions of such a ruling on the required retraining of models remain uncertain.

The Italian DPA also points to concerns about OpenAI's handling of minors' data. The company has not yet implemented age verification technology to prevent individuals under the age of 13 from accessing its system. The ChatGPT circumstances resemble recent rulings against other AI chatbots, such as Replika, which faced a similar ban due to child safety concerns.

OpenAI's platform has been likened to other machine learning systems, generating questions about the broader implications of algorithms that remember. If the Italian DPA's order is upheld, the company could be forced to delete user accounts and adopt a more thorough sign-up process. The ultimate outcome will hinge on OpenAI's ability to demonstrate the lawfulness of their data processing methods and ensure the security of their users.
